To finalize your moorage, please complete the following application form to enter into a formal agreement with the Club regarding the lease of your assigned slip.

Beam Dimension

The width of the boat, measured at its widest point. Port to Starboard.

Draft Dimension

The vertical distance from the waterline to the lowest point of the boat’s hull. From the gunwale to the deepest point of the keel. (Max depth you can operate in)

Length Overall of Vessel

Overall length of your Vessel, bow to stern, (including swim grids, anchors, outboard motors etc.)

Emergency Contact Information

Please specify who your secondary contact person is in the event we cannot reach you if there is an emergency with your vessel. In the likely event that you travel together, please do not put your spouse as the Emergency Contact.
If they are not a KYC member they will need to come to the office to arrange for a key to access the basin.

Moorage Agreement Terms & Conditions


MOORAGE TERM AND RENEWAL

Term: The moorage agreement is valid from November 1st to October 31st and will automatically renew at the end of each term unless otherwise cancelled in accordance with KYC policies. This period constitutes the “Original Term.”

Automatic Yearly Renewal
Moorage renews automatically at the start of each KYC fiscal year (November 1 – October 31), and the applicable fees will be charged to the Member’s KYC account.


VESSEL INSURANCE

All vessels must carry valid insurance coverage at all times while in the moorage basin. Proof of insurance must be submitted with this agreement. Moorage will not be granted without valid documentation on file.

As per the Moorage Policy, please upload annual proof of insurance in the assigned Moorage Member’s name showing a minimum of $2 million liability or industry standard here.

DOCUMENTATION

All operators of a vessel in the Moorage Basin must also carry proof of having:

    1. Successfully completed a boating safety course in Canada prior to April 1, 1999; or
    2. A valid Pleasure Craft Operators Card (PCOC).

SLIP ASSIGNMENTS

No Assignment
This Agreement is not assignable or transferable by the Member under any circumstances.

Reassignment of Slips
Slip reassignments or exchanges between Members are not permitted.


REGULATIONS AND CLUB POLICIES

Members are required to comply with all applicable Kelowna Yacht Club Bylaws, Code of Conduct, Regulations, and Club Policies (collectively referred to as the “Regulations and Club Policies”). These documents are subject to change and the most current versions are available on the Club’s website: www.kelownayachtclub.com. The current versions supersede all previous editions.

ASSUMPTION OF RISK AND WAIVER OF LIABILITY
By signing this Agreement, the Member is waiving, on his/her own behalf and on behalf of his/her family members, guests, and invitees, certain rights to sue KYC and is agreeing to indemnify KYC against any and all claims and liability for anything arising out of the use of KYC premises, equipment and facilities.
The Member acknowledges that KYC premises, equipment, and facilities have many inherent risks including but not limited to water-related hazards, a moorage basin and moving Vessels, inclement weather, uneven ground, ramps, slippery surfaces, docks, ropes, walkways, and pets. The Member accepts and assumes all risks arising out of, associated with, or related to activities using KYC premises and facilities, even though such risks may have been caused by the negligence of KYC.The Member covenants and agrees to release, discharge, indemnify and hold harmless KYC and its employees, directors, officers and agents from or against any and all liability whatsoever for any loss, damage, actions, claims, suits, proceedings, costs, charges, demands, expenses or direct or indirect monetary loss, (whether founded in tort or in contract or otherwise) and including claims for consequential damages, resulting from

  1. injury to or the death of any persons,
  2. damage to or loss of any property,
  3. damage to the environment, or
  4. any claim of any nature whatsoever

any of which arise directly or indirectly in any manner out of or in any way connected with the use of KYC property, premises or otherwise or attributable to the nature, construction, design, condition or state of repair of the KYC premises or any of the land and moorage basin occupied by KYC or of the Slip, or arising out of, occasioned by, or attributable to the presence on, rental, occupancy or use of KYC, any of the land and the moorage basin occupied by KYC or of the Slip occupied by the Member or by any person visiting same or being thereon and even though such liability may have been caused, or contributed to, by the negligence of KYC or its employees or agents.

EACH OF THE PARTIES, WISHING TO BE LEGALLY BOUND BY THE TERMS OF THIS AGREEMENT, HAS PLACED THEIR SIGNATURES BELOW AS OF THE DATE OF THIS AGREEMENT. THE UNDERSIGNED MEMBER, BY SIGNING BELOW, ACKNOWLEDGES HAVING READ, UNDERSTOOD AND AGREED WITH ALL THE TERMS, CONDITIONS, AND PROVISIONS OF THIS AGREEMENT.

This Agreement is made in accordance with WAREHOUSE LIEN ACT, RSBC c. 480 and the FEDERAL COURT ACT, RSC, and successor legislation and the Member acknowledges and agrees that the Moorage in this Agreement constitutes “dock charges” within the meaning of the Federal Court Act, and “warehouser’s charges” within the Warehouse Lien Act;
