Boat Partners: Vessel Ownership and Moorage Eligibility

– Where a Vessel has multiple owners, who are moorage eligible KYC Members, moorage may only be held by a single assigned membership.
– Moorage may only be held by the Kelowna Yacht Club (KYC) Member who has been offered moorage and has signed the Moorage Agreement.
– Moorage must be held in the name of a Primary Member eligible for moorage as defined by the Club Bylaws. For Corporate Memberships, moorage is held in the business name.
– If a vessel has multiple owners, only the Member on record with KYC may hold moorage. All other eligible Members with a shared ownership interest are subject to the Kelowna Yacht Club Bylaws, Code of Conduct & Regulations, and Club Policies, including the Moorage Policy.
– If the Member holding moorage ceases to do so for any reason, any remaining partners (excluding the spouse of the Member) must apply for moorage through the Moorage Wait List and are subject to all applicable policies and requirements.
– Eligible Membership Classes for moorage include: Regular, Corporate, and Life.
– If your vessel has more than one (1) boat partner, please contact the Club directly for further guidance.

Moorage Agreement Terms & Conditions

MOORAGE TERM AND RENEWAL

Term: The moorage agreement is valid from November 1st to October 31st and will automatically renew at the end of each term unless otherwise cancelled in accordance with KYC policies. This period constitutes the “Original Term.”

Automatic Yearly Renewal
Moorage renews automatically at the start of each KYC fiscal year (November 1 – October 31), and the applicable fees will be charged to the Member’s KYC account.

MOORAGE TERM AND RENEWAL *

I understand that this moorage agreement renews automatically each year on November 1st, and I agree that the associated fees will be applied to my KYC account unless I provide notice of cancellation by October 31.

VESSEL INSURANCE

All vessels must carry valid insurance coverage at all times while in the moorage basin. Proof of insurance must be submitted with this agreement. Moorage will not be granted without valid documentation on file.

VESSEL INSURANCE *

DOCUMENTATION

All operators of a vessel in the Moorage Basin must also carry proof of having:

1. Successfully completed a boating safety course in Canada prior to April 1, 1999; or
2. A valid Pleasure Craft Operators Card (PCOC).

REGULATIONS AND CLUB POLICIES

Members are required to comply with all applicable Kelowna Yacht Club Bylaws, Code of Conduct, Regulations, and Club Policies (collectively referred to as the “Regulations and Club Policies”). These documents are subject to change and the most current versions are available on the Club’s website: www.kelownayachtclub.com. The current versions supersede all previous editions.

REGULATIONS AND CLUB POLICIES *

I confirm that I have reviewed and agree to comply with the Kelowna Yacht Club’s current Regulations and Club Policies, including the Bylaws, Code of Conduct, and Moorage Policy.

ASSUMPTION OF RISK AND WAIVER OF LIABILITY
By signing this Agreement, the Member is waiving, on his/her own behalf and on behalf of his/her family members, guests, and invitees, certain rights to sue KYC and is agreeing to indemnify KYC against any and all claims and liability for anything arising out of the use of KYC premises, equipment and facilities.
The Member acknowledges that KYC premises, equipment, and facilities have many inherent risks including but not limited to water-related hazards, a moorage basin and moving Vessels, inclement weather, uneven ground, ramps, slippery surfaces, docks, ropes, walkways, and pets. The Member accepts and assumes all risks arising out of, associated with, or related to activities using KYC premises and facilities, even though such risks may have been caused by the negligence of KYC.The Member covenants and agrees to release, discharge, indemnify and hold harmless KYC and its employees, directors, officers and agents from or against any and all liability whatsoever for any loss, damage, actions, claims, suits, proceedings, costs, charges, demands, expenses or direct or indirect monetary loss, (whether founded in tort or in contract or otherwise) and including claims for consequential damages, resulting from

injury to or the death of any persons,
damage to or loss of any property,
damage to the environment, or
any claim of any nature whatsoever

any of which arise directly or indirectly in any manner out of or in any way connected with the use of KYC property, premises or otherwise or attributable to the nature, construction, design, condition or state of repair of the KYC premises or any of the land and moorage basin occupied by KYC or of the Slip, or arising out of, occasioned by, or attributable to the presence on, rental, occupancy or use of KYC, any of the land and the moorage basin occupied by KYC or of the Slip occupied by the Member or by any person visiting same or being thereon and even though such liability may have been caused, or contributed to, by the negligence of KYC or its employees or agents.

ASSUMPTION OF RISK AND WAIVER OF LIABILITY *

By checking this box, I confirm that I have carefully read and understood the Assumption of Risk and Waiver of Liability. I voluntarily accept all risks and agree to release, discharge, and indemnify KYC as described in the agreement.
